Contract

All our vessels are operated by one of the following companies: Masouras Bros Shipping Co Public Ltd, Ichthis Naftiliaki Ltd, M.P. Princess Yachts (Cyprus) Ltd, ArtDev Ltd, Sea Passion Yachting Ltd, D.D.Napa Shipping Ltd, Luxury Time Charters Ltd, Diamantides Chartering Ltd. The chartering agreement is concluded between one of the above—mentioned companies and the main person who made the reservation (hereinafter referred to as the Charterer).

Booking and prepayment

The charterer is responsible for the full payment of the lease, including any change or cancellation fees (if any).

To confirm the booking, you must make a non-refundable advance payment of 30% of the total rental price (unless otherwise specified by us additionally). Payment of the advance payment means that you, as the Charterer, accept our commercial offer, as well as the terms and conditions of this agreement.

Upon receipt of the advance payment, the Charterer will receive a confirmation of the booking by email or text message indicating the date, vessel, time, boarding location, route and rental price. Verification of the data in the confirmation is the responsibility of the Charterer. Any discrepancies must be notified to us within 7 days of sending the confirmation. The remaining rental amount must be paid no later than 7 days before the rental date.

Price

We reserve the right to change prices at any time prior to booking confirmation. After paying the advance and sending a written confirmation, the price cannot be changed, except in cases where a mandatory state tax or fee is imposed by law.

If the price is per person, we will specify the minimum number of passengers allowed. In case of reduction of the number of passengers below the established minimum, the Charterer undertakes to pay the initially agreed minimum cost.

Payments

Receipts are not accepted for payment. We accept bank transfers both to accounts in Cyprus and in international payment systems. It is also possible to pay by credit/debit card through a secure payment system using the link provided by us.

Please note that fees for international transfers are possible check with your bank.

Change or cancellation by the Charterer

If it is necessary to change the date or time of the rental, we will try to take into account your wishes if there are available resources. All changes must be made in writing.

The charterer has the right to cancel the rental at any time, provided that the cancellation is made by the main person who made the reservation and notified to us in writing. In case of cancellation, the following conditions apply:
The advance will not be refunded if cancelled less than 90 days before the rental date.
The full amount will not be refunded if cancelled less than 7 days before the rental date.
If the cost was calculated per person and the number of passengers decreased less than 30 days before the rental, there will be no refund for the missing persons.

Modification or cancellation on our part

In case of adverse weather or sea conditions, at the direction of the captain or the maritime authorities, as well as in case of technical malfunctions, we reserve the right to cancel or postpone the lease until the start time of the lease. In this case, we will suggest an alternative date or a similar vessel.

If the proposed alternatives are not suitable for the Charterer, the entire amount paid will be refunded in full. This will be the only and exclusive way to get a refund. Additional requirements on your part are not accepted.

In case the booked vessel turns out to be unavailable for reasons beyond our control (for example, breakdown, damage), we reserve the right to replace it with a similar vessel.

Booking changes after confirmation are highly unlikely, but may occur. We will notify you about such changes as soon as possible. Compensation for minor changes is not provided.

Insurance

The vessel and its inventory are insured under the marine insurance policy against damage, loss and civil liability to third parties.

We do not provide insurance against injury, illness, loss of personal property, or cancellation of a lease. The charterer is obliged to arrange the relevant insurance independently.

Force majeure

In case of force majeure caused solely by natural disasters (tornadoes, earthquakes, deaths, tsunamis, floods, ash clouds, etc.), as a result of which you cannot arrive in Cyprus and rent, a new rental date will be offered at no extra charge.

Our responsibility

We are responsible for confirmed actions or omissions of our employees and contractors within the scope of their official duties, except in cases where the damage is caused by the actions of the Charterer himself, third parties, or circumstances that we could not have foreseen.

With the exception of cases of death or bodily injury, the amount of compensation is limited to the amount paid under the contract.

Acceptance of responsibility on our part is possible only if the Charterer follows the complaint procedure described below.

Complaints

In case of problems during the rental period, inform the ship‘s captain immediately. If he is unable to solve the problem, it is necessary to contact our office immediately by phone or via WhatsApp. Failure to comply with these conditions may deprive you of the right to compensation.

Behavior on board

You and your team must treat the ship with respect, not cause damage to it, and follow the captain‘s instructions. In case of destructive behavior, the captain has the right to immediately terminate the lease, return to the port and report the incident to the maritime authorities. The Company is not responsible for the consequences.

In case of excessive alcohol consumption and inappropriate behavior of passengers, the captain has the right to stop the flight.

Captain‘s authority

You and your team must treat the ship with respect, not cause damage to it, and follow the captain‘s instructions. In case of destructive behavior, the captain has the right to immediately terminate the lease, return to the port and report the incident to the maritime authorities. The Company is not responsible for the consequences.

In case of excessive alcohol consumption and inappropriate behavior of passengers, the captain has the right to stop the flight.

Covid-19

In case of cancellation of the lease due to a lockdown imposed by the local authorities during the rental period, you are entitled to a full refund within 14 business days from the date of notification.

If the decrease in the number of participants is caused by restrictions, the lease may take place. It is possible to postpone the lease to a later date while retaining the deposited amount.

Data protection
